No platform can be used without creating a (at least temporary) data construct to the retrieving user, which reflects the identity of the user and enables an assignment of the application data. This thesis examines the construct of digital identity and puts it into the fundamental rights framework. In doing so, data protection and IT security law are also consulted as concrete manifestations of fundamental rights

Should I CARE about FAIR? – Ein juristischer Blick auf Prinzipien des Forschungsdatenmanagements –

Der Umgang mit Forschungsdaten und deren nachhaltige, langfristige Nutzung alsZiel des Forschungsdatenmanagements sind in aller Munde. Spätestens mit Beginnder Open-Data-Bewegung zeigt sich die Notwendigkeit übergeordneter Prinzipien fürForscher:innen. Beim Aufeinandertreffen von Forschenden diverser Wissenschaftenund Jurist:innen erhalten die mit dem Thema eng verzahnten FAIR- und CARE-Prin-zipien immer größere Bedeutung. Rechtliche Fragen sind oftmals nicht nur von einemjuristischen Standpunkt, sondern auch aus einem ethischen Blickwinkel zu betrachten.Die Rechtswissenschaft verfügt aber bislang weder über eine Einordnung noch vertie-fende Literatur zu diesen Prinzipien.Ziel dieses Beitrags ist daher eine Einführung in die Prinzipien selbst sowie eineerste Einordnung, um Rechtswissenschaftler:innen in inter- und multidisziplinär for-schenden Projekten einen Überblick zu geben. Zugleich soll so die Brücke zwischenNicht-Jurist:innen und Jurist:innen geschlagen werden
